Exit Management
Resignation
- The employee is responsible for submitting the resignation form to the line manager with at least 3 months notice period and for fulfilling the commitments as per the employment contract.
- HR shall review the resignation with all relevant parties and obtain the line manager approval.
- The employee can withdraw the resignation within one week from the resignation notification date.
- HR shall prepare the exit documents below:
- Resignation Form to be signed by the employee as well as direct manager and Head of HR.
- Exit interview Form to be signed by the employee.
- Disclaimer and Clearance Forms signed by the employees and all parties concerned.
- Social Insurance Form 6 to be signed by the employee.
- Employees are entitled to receive the remaining annual leave until the exit date either cash or leave days.
- HR should notify the IT department and all concerned parties to deactivate the employee user accounts.
- Line manager to state if an e-mail backup is needed or to be forwarded to the new replacement.
Retirement
- Labor law authorizes the company to terminate the employee’s employment relationship upon reaching the retirement age according to labor law accordingly, the employee who have spent a minimum of 5 years of service shall receive an end of service bonus which is calculated on the last basic salary:
- The 1st 5 years of service, the employee is entitled for one month basic for each year.
- The 2nd 5 years of service, the employee is entitled for one and half month basic for each year.
- After the 10th year of service, the employee is entitled for two months basic for each year.
- HR shall carry out the normal exit procedures outlined in the “Resignation” part.
Death
- Upon the death note of one of the employees, the company releases an amount equivalent to five months of the last gross salary according to labor law to the beneficiary’s name as per stated in the signed Emergency Form.
- HR shall send an official notification to the life insurance provider attaching the death certificate.
- HR sends the legacy notification statement to the legal to confirm the distribution % for the insurance amount (if any).
End of Contract
- This applies if the employee is on annual contract in which the direct manager confirms not renewing the contract.
- HR should review all employees’ contracts at the end of each month and prepares a list of contracts that will expire within the next 2 months to be sent to line managers and the concerned HOD.
- In case of renewal, HR shall notify the employee of renewing the contract for another term. The employee shall sign the Contract Renewal Form to be approved by the authorized party.
- In the case of non-renewal, HR notifies the employee that the company will not renew the contract.
- The employee should sign the End of Contract Form, in case the employee doesn’t sign, HR shall send the original form through his mail or by post on his official e-mail address with knowledge of receipt.
- HR shall carry out the normal exit procedures outlined in the “Resignation” part.
Legal Dismissal
- The company reserves the right to terminate the employee contract if he commits a serious violation during his/her employment, as per labor law article 69.
- In the event of the stated violations, Legal shall carry out an official investigation in which the employee is prohibited from working until the completion of the investigation. Upon investigation results in the evet of proven violation(s): HR shall carry out the normal exit procedures outlined in the “Resignation” part and in case refused to sign, HR shall notify the Legal Department to take all legal measures towards the employee.
